Once a Party Wall Notice has been served, the adjoining owner(s) can agree or disagree with the proposed building works set out within the notice. If the adjoining owner disagrees, the proposals are said to be 'in dispute'. The Party Wall etc. Act 1996 provides a course of action for resolving disputes set out under Section 10 of the act, requiring Party Wall Surveyors to be appointed to make an impartial award (Party Wall Award).
TLC Party Wall Surveyors are available to act on your behalf to negotiate and draw up the Party Wall Award documents. The adjoining owner has the right to appoint their own surveyor, or if in agreement they can use the same surveyor as the building owner, referred to as an ‘Agreed Surveyor’. If separate surveyors are appointed they are required to agree on the appointment of a 'Third Surveyor' who will adjudicate in the event that the appointed surveyors do not agree.
